Privacy Policy

This privacy policy covers MODE’s collection and treatment of information and data collected when you visit MODE websites or use MODE services under the domains of tinkermode.com, modesensor.cloud, and modeapps.cloud.

1. Definitions

1.1 “We” and “MODE” means the entity MODE, Inc.

1.2 “You” means yourself and any entities you represent.

1.3 “Personal Identification Information” or “PII” means any personally identifiable information that you shared with MODE.

2. What information do we collect?

2.1 Like many websites, we collect website access data in order to improve and enhance our customer experience.

2.2 We collect data sent from devices that you connect to our cloud via api.tinkermode.com.

2.3 We may collect Personal Identification Information (PII) you provide to us by creating an account on services that are built using our IoT platform. The information includes, but not limited to your name, email address, and payment information.

3. How do we use the data?

3.1 We use the data we collected to provide you service, improve our services, troubleshoot issues, and provide customer support.

3.2 We may use the email address you provide to us to send you communication and/or promotional information about products, services, and other activities of MODE.

3.3 We may collect and generate anonymous data by excluding personally identifiable information. We reserves the right to use anonymous data for any purpose and disclose anonymous data to third parties at its sole discretion.

4. When do we share information?

4.1 When appropriate, we may share data with entities and persons who are actively doing business with us and have entered into a contract with MODE. A company of this sort will have access to the data generated by individuals who are users of the product they provided or the data generated by using their software services.

4.2 We may engage third-party service providers to work with us to administer and provide the Service. These third-party service providers have access to your Personal Identifiable Information only for the purpose of performing services on our behalf.

4.3 Your Personal Data may be disclosed to third parties in order to comply with the applicable law or with orders from public authorities or to exercise a right in front of the Court.

4.4 Your Personal Data may be disclosed to third parties if we believe that it is reasonably necessary to investigate, prevent or take action regarding alleged illegal activities; violation of our terms of service or other agreements; fraud, security or technical issues; to protect our rights or property; or situations involving potential threads to the physical safety of any person.

4.5 We also may disclose your personal information to a buyer or other successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of our assets.

5. How do we protect your information?

5.1 We take reasonable administrative, physical and electronic measure designed to protect the information that we collect from or about you from unauthorized access, use or disclosure. Please be aware, however, that no method of transmitting information over the Internet or storing information is perfectly safe.

6. Other terms

6.1 By registering to one of our services, you signify your acceptance of this Privacy Policy and our Terms of Service. If you do not agree to the Privacy Policy or Terms of Service, please do not use our services.

6.2 You can request to opt-out from providing your Personal Data and we respect your choice. However, if you decide not to provide us with the PII, some of the services and/or functionalities may not be available.

6.3 MODE may assign or transfer this Privacy Policy, and Your Personal Data, in the event MODE is involved in a merger, acquisition, bankruptcy, reorganization, or sale of its assets. You will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of Your Personal Data.

6.4 Some browsers may offer a “Do Not Track” feature. We do not currently respond to “Do Not Track” signals.

6.5 If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third parties’ for direct marketing purposes. 6.6 MODE will not intentionally gather information from children under the age of 13.

6.7 MODE reserves the right to make changes to this Privacy Policy at any point without prior notification or approval.
